แม้จะเป็นการปฏิวัติหรือรัฐประหารก็ตามถ้าหากคณะปฏิวัติหรือคณะรัฐประหารเป็นรัฎฐาธิปัตย์ที่สามารถออกคำสั่ง คำบัญชาในฐานะเป็นกฎหมายของประเทศได้ 3. กฎหมายต้องเป็นคำสั่งหรือข้อบังคับที่ใช้ได้ทั่วไป หมายความว่า กฎหมายต้องเป็นเรื่องที่เมื่อประกาศใช้แล้วจะมีผลบังคับเป็นการทั่วไป ไม่ใช่กำหนดขึ้นเพื่อประโยชน์ของบุคคลหนึ่ง หรือให้บุคคลหนึ่งบุคคลใดปฏิบัติตามเท่านั้น ไม่ว่าบุคคลนั้นจะมีอายุ เพศ หรือฐานะอย่างไรก็ตกอยู่ภายใต้ของการใช้บังคับกฎของกฎหมายอันเดียวกัน (โดยไม่เลือกปฏิบัติ) เพราะบุคคลทุกคนมีความเสมอภาคที่จะได้รับความคุ้มครองตามกฎหมายเท่าเทียมกัน แม้กฎหมายบางอย่างอาจจะมีวัตถุประสงค์ที่จะให้ประโยชน์แก่บุคคล หรือวางความรับผิดชอบให้แก่คนบางหมู่เหล่า แต่ก็ยังอยู่ในความหมายที่ว่าใช้บังคับทั่วไปอยู่เหมือนกัน เพราะคนทั่ว ๆ ไปที่เข้ามาเกี่ยวข้องในกฎหมายนั้นก็ยังต้องปฏิบัติตามอยู่เสมอ 4. กฎหมายบัญญัติขึ้นเพื่อให้บุคคลปฏิบัติตาม แม้การปฏิบัติบางครั้งอาจจะเกิดจากความไม่เต็มใจที่จะปฏิบัติ แต่หากเป็นคำสั่ง คำบัญชาแล้ว ผู้รับคำสั่ง คำบัญชา ต้องปฏิบัติตาม หากขัดขืนไม่ปฏิบัติตามก็จะเกิดสภาพบังคับของกฎหมาย อันเป็นผลร้ายต่อผู้ฝ่าฝืนคำสั่งนั้น และเป็นที่พึงเข้าใจด้วยว่าผู้ที่อยู่ในฐานะที่จะรับคำสั่งและปฏิบัติตามกฎหมายได้นั้นต้องเป็นบุคคลตามกฎหมาย อย่างไรก็ดีแม้กฎหมายจะไม่ใช้บังคับแก่สัตว์ แต่ก็มีความจำเป็นที่จะต้องควบคุมมิให้สัตว์ก่อความเสียหายหรือความเดือดร้อนรำคาญแก่มนุษย์ ดังนี้กฎหมายจึงกำหนดความรับผิดไว้กับบุคคลผู้เป็นเจ้าของที่ปล่อยปะละเลยไม่ควบคุมดูแลสัตว์เลี้ยงของตนตามสมควร จึงมิใช่เป็นการออกคำสั่ง คำบัญชาแก่สัตว์ แต่เป็นการควบคุมโดยผ่านทางผู้เป็นเจ้าของเท่านั้น ตัวอย่างเช่น ประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 433 บัญญัติว่า “ถ้าความเสียหายเกิดขึ้นเพราะสัตว์ ท่านว่าเจ้าของสัตว์หรือบุคคลผู้รับเลี้ยงรับรักษาไว้แทนเจ้าของ จำต้องใช้คำเสียหายทดแทนให้แก่ฝ่ายที่ต้องเสียหาย” 5. กฎหมายต้องมีสภาพบังคับ กฎหมายนั้นเป็นบรรทัดฐานทางสังคมที่เชื่อมโยงกับอำนาจบังคับฝ่ายเดียวของรัฐ กล่าวคือ กฎหมายนั้นมีสิ่งที่เรียกว่า "สภาพบังคับ" (SANCTION) สภาพบังคับของกฎหมายนั้นแบ่งเป็นสภาพบังคับในทางอาญาและทางแพ่ง สภาพบังคับให้ทางอาญาโดยทั่วไปแล้วคล้ายคลึงกัน คือ หากเป็นโทษสูงสุดจะใช้วิธีประหารชีวิต ซึ่งบางประเทศใช้วิธีการนั่งเก้าอี้ไฟฟ้า แขวนคอ แต่ประเทศไทยในปัจจุบันให้นำไปฉีดยาให้ตายใช้วิธีประหารด้วยวิธีอื่นไม่ได้ นอกจากนั้นก็เป็นการจำคุก เป็นการเอาตัวนักโทษควบคุมในเรือนจำ ซึ่งต่างกับกักขังเป็นการเอาตัวไปกักไว้ที่อื่นที่มิใช่เรือนจำ เช่นที่อยู่ของผู้นั้นเอง หรือสถานที่อื่นที่ผู้ต้องกักขังมีสิทธิดีกว่าผู้ต้องจำคุก สำหรับกฎหมายไทยโทษกักขังจะใช้เฉพาะผู้ซึ่งกระทำผิดครั้งแรก และความผิดนั้นมีโทษจำคุกไม่เกินสามเดือน ศาลจึงจะลงโทษกักขังแทนจำคุกได้ ส่วนการปรับคือ ให้ชำระเงินตามที่กฎหมายกำหนดไว้ในคำพิพากษาต่อศาล การริบทรัพย์สิน คือ การริบเอาทรัพย์นั้นตกเป็นของแผ่นดิน เช่น ปืนที่เตรียมไว้ยิงคน หรือเงินที่ไปปล้นเขามา นอกจากการริบแล้วอาจสั่งทำลายทรัพย์สินนั้นเสียก็ได้ สภาพบังคับในทางแพ่งก็ได้แก่ การกำหนดให้การกระทำที่ฝ่าฝืนกฎหมายตกเป็นโมฆะ ตัวอย่างเช่น การซื้อขายที่ดินโดยมิได้ทำเป็นหนังสือ หรือปรับไม่เกินหกพันบาทหรือทั้งจำทั้งปรับ” ฉะนั้น กฎหมายอาญาจึงต้องประกอบไปด้วยส่วนที่บัญญัติถึงความผิด และส่วนที่บัญญัติถึงโทษด้วย ส่วนโทษอาญาที่บัญญัติไว้ในประมวลกฎหมายอาญา ได้แก่ ประหารชีวิต จำคุก กักขัง ปรับ ริบทรัพย์สิน นอกจากที่บัญญัติไว้ในประมวลกฎหมายอาญาแล้ว ยังมีพระราชบัญญัติอื่นที่กำหนดความผิดเฉพาะเรื่อง และวางโทษไว้ด้วย เช่น พระราชบัญญัติยาเสพติดให้โทษ พระราชบัญญัติอาวุธปืน เครื่องปืน และวัตถุระเบิด และพระราชบัญญัติการพนัน พระราชบัญญัติจราจรทางบก พระราชบัญญัติศุลกากร เป็นต้น พระราชบัญญัติพิเศษที่ระบุความผิดทางอาญา และกำหนดโทษไว้ด้วยเหล่านี้รวมเรียกว่ากฎหมายอาญาทั้งสิ้น หลักเกณฑ์สำคัญของประมวลกฎหมายอาญา มีดังนี้ จะไม่มีความผิดโดยไม่มีกฎหมาย หมายความว่า กฎหมายอาญาจะใช้บังคับได้เฉพาะการกระทำซึ่งกฎหมายที่ใช้อยู่ในขณะนี้ถือว่าเป็นความผิด ถ้ากฎหมายที่ใช้อยู่ในขณะกระทำไม่ถือว่าเป็นความผิดแล้ว จะถือว่าการกระทำนั้นเป็นความผิดไม่ได้ และจะลงโทษกันไม่ได้ หลักเรื่องกฎหมายอาญาไม่มีผลย้อนหลังนี้ กฎหมายไม่ให้ย้อนหลังก็เฉพาะที่จะเป็นผลร้ายแก่ผู้กระทำความผิดเท่านั้น เช่น การกระทำความผิดใดที่ล่วงเลยการลงโทษ หรือล่วงเลยอายุความฟ้องร้อง แม้จะได้มีกฎหมายใหม่บัญญัติกำหนดอายุความมากขึ้นกว่าเดิม ก็จะเอาตัวผู้กระทำมาฟ้องร้องลงโทษไม่ได้ แต่หากกฎหมายใหม่เป็นคุณแก่ผู้กระทำความผิดมากกว่ากฎหมายเก่าเช่นนี้ กฎหมายก็ให้มีผลย้อนหลังได้ เช่น ประมวลกฎหมายอาญา มาตรา 3 บัญญัติว่า “ถ้ากฎหมายที่ใช้ในขณะกระทำความผิดแตกต่างกับกฎหมายที่ใช้ในภายหลังการกระทำความผิด ให้ใช้กฎหมายในส่วนที่เป็นคุณแก่ผู้กระทำความผิดไม่ว่าในทางใด...” จะไม่มีโทษโดยไม่มีกฎหมาย คือบุคคลจะต้องรับโทษต่อเมื่อมีกฎหมาย ที่ใช้อยู่ในขณะกระทำบัญญัติให้ต้องรับโทษนั้น ๆ เช่น การกระทำความผิดที่มีแต่โทษปรับ ศาลก็ลงโทษได้แต่โทษปรับ ศาลจะลงโทษจำคุกซึ่งไม่ใช้โทษที่กฎหมายบัญญัติไว้ไม่ได้ จะต้องตีความกฎหมายอาญาโดยเคร่งครัด กล่าวคือ กรณีที่ถ้อยคำของกฎหมายเป็นที่น่าสงสัย จะตีความโดยขยายความไปลงโทษหรือเพิ่มโทษผู้ต้องหาไม่ได้ แต่อาจตีความโดยขยายความให้เป็นผลดีแก่ผู้ต้องหาได้ ฉะนั้น Because of this, SPTF reviewed two requests concerning the lifecycle of the Sister Projects to work through and demonstrate the review process.
